Radio Boise's App Terms of Use

Effective date: October 6, 2026

These Terms of Use ("Terms") are an agreement between you and Boise Community Radio Project, the nonprofit that operates Radio Boise (KRBX 89.9 & 93.5 FM) ("Radio Boise," "we," "our," or "us"). They apply to the Radio Boise mobile app and any updates to it (the "App"). By downloading or using the App, you agree to these Terms. If you don't agree, please don't use the App.

License to Use the App

Radio Boise gives you a personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your own personal, noncommercial use. Radio Boise keeps all rights not expressly given to you in these Terms.

The App is licensed to you, not sold. Radio Boise and its licensors own the App, including its design, code, logos, and the Radio Boise and KRBX names.

Acceptable Use

When using the App, you agree not to:

- Copy, modify, distribute, sell, or sublicense the App

- Reverse engineer, decompile, or try to access the App's source code, except where the law allows it

- Record, rebroadcast, retransmit, or redistribute the stream or any App content

- Use the App for any commercial purpose, such as playing the stream in a business, without our written permission

- Use the App in a way that breaks the law, interferes with the App or our servers, or harms Radio Boise or other users

U- se any features that let you send messages or song requests to harass, threaten, or abuse anyone

Station Content

The music, programs, and other content in the App are provided for personal listening only. Music and other content may be owned by artists, record labels, and other rights holders, and are used under license. Program schedules, playlists, and availability may change at any time without notice.

Donations and Purchases

The App may link to our website or a third-party payment processor so you can donate or make purchases. Those transactions are covered by the terms of the site or processor you use. Donations to Radio Boise are tax-deductible to the extent allowed by law and are nonrefundable except as required by law or at Radio Boise's discretion.

Privacy

Our Privacy Policy explains what information we collect through the App and how we use it. By using the App, you agree to the collection and use of information as described there. The App may collect technical information about your device, such as device type, operating system, and app version, along with general listening data, to provide updates, support, and improve the App.

Outside Services and Links

The App may link to or connect with websites, social media, payment processors, and other services that Radio Boise doesn't control ("Outside Services"). We aren't responsible for their content, accuracy, or practices, and your use of them is at your own risk and subject to their terms.

Data Charges

Streaming audio uses data. You are responsible for any data, internet, or mobile carrier charges from using the App.

App Store Terms

If you download the App from the Apple App Store or Google Play, you also agree to that store's terms and usage rules. If there's a conflict, the store's terms apply to the extent required.

If you downloaded the App from the Apple App Store:

- These Terms are between you and Radio Boise, not Apple. Radio Boise, not Apple, is responsible for the App and its content.

- Apple has no obligation to provide maintenance or support for the App.

- If the App fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. Apple has no other warranty obligation for the App.

- Radio Boise, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims.

- You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of restricted parties.

- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

No Warranty

The App is provided "as is" and "as available." To the fullest extent allowed by law, Radio Boise makes no warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the App or stream will always be available, uninterrupted, or error-free. Some places don't allow these exclusions, so they may not apply to you.

Limitation of Liability

To the fullest extent allowed by law, Radio Boise and its directors, staff, and volunteers will not be liable for any indirect, incidental, special, or consequential damages, including loss of data, arising from your use of or inability to use the App. Radio Boise's total liability to you for any claim related to the App will not exceed $50. Some places don't allow these limitations, so they may not apply to you.

Ending Your Use

These Terms stay in effect until ended by you or Radio Boise. You can end them at any time by deleting the App. Your rights under these Terms end automatically if you don't follow them. We may change, suspend, or discontinue the App, or any part of it, at any time.

Changes to These Terms

We may update these Terms from time to time. When we do, we'll post the new version in the App or on our website and update the effective date. Continuing to use the App after changes means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict of law rules. Any dispute related to these Terms or the App will be handled in the state or federal courts located in Ada County, Idaho.
